1. About These Terms

These Terms & Conditions (“Terms”) govern the contractual relationship between Behind the Yoga Mat (“Behind the Yoga Mat”, “we”, “us” or “our”) and customers or participants (“you”, “your”, "Yogi" or “participant”) purchasing or using our products and services.

These Terms apply, where relevant, to:

  • online courses and digital learning content;
  • live online programmes and sessions;
  • individual and group coaching;
  • yoga classes;
  • workshops and events;
  • yoga retreats;
  • digital resources and course materials;
  • community and learning-platform access; and
  • other educational, coaching, yoga or movement-related services offered by Behind the Yoga Mat.

The description, scope, duration, price and any specific conditions of an individual offer will be provided on the relevant sales page, booking page, course page, written offer or booking confirmation.

Where specific conditions communicated for an individual service differ from these general Terms, those specific conditions apply to that service to the extent of the difference, subject to mandatory law.

Consumers and business customers

Our services may be purchased by consumers and business customers unless an individual offer states otherwise.

A consumer is a person entering into a transaction primarily for purposes outside their trade, business, craft or profession.

A business customer is a person or legal entity acting for purposes relating to their trade, business or professional activity.

Where mandatory consumer-protection rules apply, those rules take precedence over conflicting provisions of these Terms.

Nothing in these Terms excludes or restricts rights that cannot legally be excluded or restricted.

2. Booking and Contract Formation

The presentation of a course, programme, coaching service, workshop, event, retreat or other service on our website does not necessarily constitute a legally binding offer unless expressly stated otherwise.

A contract is concluded when a booking or purchase is accepted through the booking process applicable to the relevant service.

Depending on the service, this may occur when:

  • you complete an online checkout and your order is accepted;
  • you receive confirmation of your booking;
  • we confirm your booking by email;
  • you accept an individual written offer; or
  • another clearly identified booking process is completed.

Before submitting an online order, you will be given the opportunity to review the relevant offer information, including the essential characteristics and price of the service.

Where required, you will also be asked to accept these Terms before completing the booking.

We recommend retaining your booking or order confirmation and the version of these Terms applicable at the time of purchase.

Service-specific conditions

Certain services may have additional conditions concerning matters such as:

  • dates and schedules;
  • minimum participant numbers;
  • included services;
  • accommodation;
  • access periods;
  • payment schedules; or
  • cancellation arrangements.

Where applicable, these conditions will be communicated before booking and form part of the contractual agreement.

3. Prices, Payments and Instalment Plans

The price applicable to a product or service is the price displayed or otherwise communicated at the time of booking.

Prices will indicate applicable taxes where required by law.

Payment may be made using the payment methods offered during checkout or otherwise specified for the relevant service. Depending on the offer, available payment methods may include:

  • credit or debit card;
  • Apple Pay;
  • Google Pay;
  • bank transfer; or
  • other payment methods made available at checkout.

Payment processing may be carried out by authorised third-party payment providers.

Unless otherwise stated for the particular service, payment is due at the time of booking.

Instalment plans

For certain programmes, retreats or higher-value services, Behind the Yoga Mat may offer payment in instalments.

Where an instalment plan is available, the total price, individual payment amounts and applicable payment schedule will be communicated before purchase.

An instalment plan is a method of paying the agreed total purchase price. It does not, by itself, convert a fixed programme or service into a monthly subscription and does not create a right to cancel the contract merely by stopping future payments.

Participants remain responsible for instalments due under the agreed contract unless:

  • the contract has been validly withdrawn from or terminated;
  • Behind the Yoga Mat agrees otherwise; or
  • mandatory law provides otherwise.

Failed or overdue payments

If a payment fails, Behind the Yoga Mat may request an alternative payment method or payment of the outstanding amount within an appropriate period.

Where an amount remains overdue after an appropriate reminder and payment period, Behind the Yoga Mat may, where legally permitted, temporarily suspend access to the relevant paid service until the outstanding amount is settled.

Any mandatory statutory rights and rules concerning payment default remain unaffected.

4. Statutory Withdrawal Rights

Consumers entering into contracts online or through other means of distance communication may have a statutory right to withdraw from the contract, generally within 14 days, subject to the requirements, conditions and exceptions provided by applicable consumer law.

Whether a statutory withdrawal right applies, and when it may expire or be excluded, depends on the nature of the purchased service.

Different legal rules may apply to, for example:

  • digital content;
  • digital services;
  • services beginning during the withdrawal period;
  • leisure activities scheduled for a specific date or period; and
  • other services for which a statutory exception applies.

Nothing in these Terms removes or restricts a statutory withdrawal right where such a right applies.

Digital content and immediate access

Where digital content, online courses or other digital materials are made available before the expiry of an applicable statutory withdrawal period, the commencement of access and any resulting effect on the statutory right of withdrawal will be handled in accordance with applicable consumer law.

Where legally required, Behind the Yoga Mat may obtain the customer's express consent to the immediate supply of digital content and acknowledgement of the consequences for the statutory right of withdrawal.

Where the legal requirements for the loss of the statutory right of withdrawal have been satisfied, the customer may no longer withdraw from the purchase solely because they have changed their mind after access to the digital content has begun.

This provision does not prescribe a particular technical checkout process or wording. Any legally required consent or acknowledgement will be implemented as appropriate to the purchasing system in use at the relevant time.

Services beginning during the withdrawal period

Where a customer requests that a service, such as coaching or another live service, begin before an applicable statutory withdrawal period has expired, the consequences of beginning performance will be determined in accordance with applicable consumer law.

Where separate consent, acknowledgement or information is legally required, this will be provided through the relevant booking or purchasing process.

Voluntary cancellation policies

The voluntary cancellation policies provided by Behind the Yoga Mat for particular services are separate from statutory withdrawal rights.

The applicable voluntary cancellation conditions can be found in the relevant service section of these Terms, including:

  • Online Courses and Digital Content;
  • Live Online Programmes & Coaching;
  • Workshops & Events; and
  • Retreats.

A voluntary cancellation policy does not replace, remove or restrict mandatory statutory rights.

Statutory warranty rights

Loss or expiry of a statutory withdrawal right does not remove statutory rights relating to defective or non-conforming products, digital content or services.

Those rights are addressed separately under Liability and Statutory Rights in these Terms.

5. Online Courses and Digital Content

Behind the Yoga Mat may provide self-paced online courses, videos, audio content, workbooks, templates, exercises, downloads and other digital learning materials.

The specific content, scope, price and access period of each course or digital product will be stated in the relevant offer.

Course access

After successful purchase, access will normally be provided through our online learning platform.

Access is provided for the period specified at the time of purchase. Unless permanent or “lifetime” access is expressly promised, purchase of a course does not guarantee indefinite access to the platform or content.

Behind the Yoga Mat may make reasonable technical, organisational or educational updates to a course, provided that these do not materially reduce the essential content or value of the product purchased.

Personal accounts and access

Access to a paid course, programme, member area or digital product is personal to the person who purchased or was validly granted access to it.

Login credentials must not be:

  • shared with another person;
  • published or distributed;
  • sold or transferred; or
  • used to provide unauthorised third-party access.

Participants are responsible for taking reasonable measures to keep their login credentials secure.

Where Behind the Yoga Mat reasonably suspects unauthorised account sharing or other material misuse, access may be temporarily restricted while the matter is investigated.

Confirmed misuse may result in suspension or termination of access in accordance with these Terms and applicable law.

The intellectual property and permitted-use rules applying to all course materials are set out in Part – Intellectual Property and Personal Use.

Technical requirements and platform availability

Access to online courses and digital content requires a suitable internet connection and compatible device, browser and software.

Participants are responsible for maintaining the equipment and internet connection reasonably necessary to use the service.

Behind the Yoga Mat aims to provide reliable access but cannot guarantee that online platforms will operate without interruption at all times.

Temporary interruptions may occur because of maintenance, software updates, security measures, technical failures, internet disruption or issues affecting third-party platforms.

Where reasonably possible, Behind the Yoga Mat will seek to minimise material disruption.

Temporary interruptions that do not materially impair the purchased service do not automatically create an entitlement to a refund.

Mandatory statutory rights relating to digital content and digital services remain unaffected.

6. Live Online Programmes & Coaching

Behind the Yoga Mat may offer:

  • individual coaching;
  • group coaching;
  • live online programmes;
  • mentoring or educational sessions;
  • scheduled online classes or calls;
  • programmes combining live sessions with digital course materials.

The scope, duration, number of sessions, format and included services will be stated in the relevant offer.

Where a programme consists of several sessions or elements, the booking is generally for the programme as a whole rather than for each individual component, unless otherwise stated.

Individual appointments

For individually scheduled 1:1 coaching or online sessions, the following voluntary cancellation and rescheduling conditions apply unless different conditions are communicated before booking.

More than 48 hours before the scheduled start
The appointment may be cancelled or rescheduled without a cancellation charge.

Between 24 and 48 hours before the scheduled start
50% of the price attributable to the affected session may be charged.

Less than 24 hours before the scheduled start or no-show
100% of the price attributable to the session may be charged.

Where a session forms part of a prepaid package, a session cancelled less than 24 hours before its scheduled start or missed without cancellation may be treated as used.

Group programmes and scheduled live sessions

Group calls and live sessions forming part of a programme cannot necessarily be rescheduled for individual participants who are unable to attend.

Where recordings, replacement materials or other alternatives are included, they will be provided as described in the relevant offer.

There is no automatic entitlement to:

  • a recording;
  • an individual replacement session;
  • an alternative group date; or
  • a partial refund

because a participant is unable to attend an individual scheduled session, unless otherwise required by law or expressly included in the offer.

Cancellation of a fixed programme

Where a participant purchases a fixed programme consisting of several sessions, modules or services, cancellation or non-attendance of an individual component does not automatically terminate the overall contract or remaining payment obligations.

Where Behind the Yoga Mat offers a separate voluntary cancellation or satisfaction policy for a particular programme, those conditions will be clearly communicated before purchase.

Mandatory statutory withdrawal and consumer rights remain unaffected.

Nature of coaching and educational services

Coaching and educational services are intended to support personal or professional development within the scope described in the relevant offer.

Unless expressly stated otherwise, they do not constitute medical treatment, psychotherapy, legal advice, tax advice or financial advice.

Participants remain responsible for their own decisions and for determining how they apply information obtained through coaching or educational programmes.

Behind the Yoga Mat does not guarantee a particular personal, professional, business or financial outcome.

7. Workshops & Events

The content, location, date, duration, price and included services of each workshop or event will be stated in the relevant booking information.

Your booking applies only to the event and services expressly described. Unless otherwise stated, travel, accommodation, food, parking and other personal expenses are not included.

Behind the Yoga Mat may make reasonable changes to the programme, timetable, instructor, location within a reasonable geographic area or individual elements of an event where necessary, provided that the essential nature of the booked service is not materially changed.

Material changes affecting statutory customer rights will be handled in accordance with applicable law.

Voluntary cancellation for workshops and events

Unless different cancellation conditions are clearly communicated for a particular event before booking, the following voluntary cancellation policy applies to workshops, individual yoga events and comparable in-person events organised directly by Behind the Yoga Mat.

More than 48 hours before the scheduled start
The booking may be cancelled without a cancellation charge. Amounts already paid for the event will be refunded.

Between 24 and 48 hours before the scheduled start
50% of the booking price is payable. If the full amount has already been paid, 50% of the booking price will be refunded.

Less than 24 hours before the scheduled start
100% of the booking price is payable. No voluntary refund will be provided.

No-show
If you do not attend without cancelling, 100% of the booking price remains payable and no refund will be provided.

These voluntary cancellation conditions are separate from any mandatory statutory rights that may apply.

8. Retreats

Retreats may combine yoga, movement, workshops, coaching or other Behind the Yoga Mat services with accommodation, catering or services supplied by third parties.

The relevant retreat description will clearly specify which services are included in the price payable to Behind the Yoga Mat and which services are not included.

Bookings made directly through Behind the Yoga Mat

Where a retreat or retreat package is booked directly through Behind the Yoga Mat, and Behind the Yoga Mat is the contractual provider of the relevant booked services, the cancellation provisions set out below apply.

Bookings made directly with a hotel or venue

Where accommodation, meals or another service is booked directly between the participant and a hotel, retreat venue or other third-party provider, this contract is separate from the contract with Behind the Yoga Mat.

The third party’s own payment conditions, cancellation conditions, refund policy and booking terms apply to that separate booking. Behind the Yoga Mat is not responsible for refunds owed under a contract entered into directly between the participant and such third party.

This distinction will be clearly stated in the relevant retreat booking information.

Travel arrangements and personal responsibility

Unless expressly included in the relevant retreat offer, participants are responsible for arranging and paying for their own travel, flights, transfers, passports, visas, travel documentation and personal insurance.

Appropriate travel and cancellation insurance is strongly recommended, particularly for retreats involving advance travel or accommodation arrangements.

Where a participant cannot attend because of illness, personal circumstances, transportation disruption, flight cancellation or another event affecting the participant, the applicable cancellation policy continues to apply unless mandatory law provides otherwise.

Behind the Yoga Mat is not responsible for independently booked travel, accommodation or other costs merely because a Behind the Yoga Mat service is changed or cancelled, except where liability cannot legally be excluded.


Voluntary cancellation for retreats booked through Behind the Yoga Mat

Unless different conditions are expressly communicated for a particular retreat before booking, the following voluntary cancellation policy applies to retreat services booked directly through Behind the Yoga Mat.

More than 90 days before the retreat begins

100% of the amount paid to Behind the Yoga Mat will be refunded.

Between 30 and 90 days before the retreat begins

50% of the booking price paid to Behind the Yoga Mat will be refunded.

Less than 30 days before the retreat begins

No voluntary refund will be provided.

No-show

No refund will be provided if a participant does not attend the retreat.

Late arrival, early departure and unused services

No partial refund will be provided where a participant arrives late, leaves early, misses individual sessions, chooses not to participate in part of the programme, or does not use an included service.

This does not restrict mandatory legal rights that cannot be excluded.

Transfer of a retreat place

If a participant is unable to attend a retreat, they may request permission to transfer their place to another suitable participant. Any transfer requires prior agreement from Behind the Yoga Mat.

A transfer may be refused where there is a reasonable reason for doing so, including where the substitute participant does not meet clearly stated participation requirements, a hotel or other provider does not permit the change, the transfer cannot reasonably be administered before the retreat, or applicable legal or organisational requirements prevent the transfer.

Reasonable administrative or third-party costs directly resulting from the transfer may be charged where legally permitted. Any such costs will be communicated before the transfer is completed.

9. Health, Participation and Hands-On Adjustments

Yoga, movement classes, workshops, events and retreats involve physical activity. Participants are responsible for listening to their own bodies, practising within their personal abilities and limits, and making reasonable decisions about their participation.

Health and participation

By participating, you confirm that, to the best of your knowledge, you are able to participate safely in the relevant activity.

If you have an injury, are pregnant, have recently undergone surgery, have a medical condition, are receiving medical treatment, or have another circumstance that may materially affect safe participation, you should seek appropriate professional medical advice before participating where necessary and inform the instructor of relevant limitations before the activity begins.

Participants should stop or modify an exercise if they experience pain, dizziness, unusual discomfort or another symptom suggesting that continuing may not be appropriate.

Instructions, demonstrations, modifications and other guidance provided during yoga or movement activities are general in nature and are not a substitute for individual medical diagnosis, advice or treatment.

Behind the Yoga Mat will take reasonable care in providing its services but cannot assess every participant's individual health circumstances or physical limitations.

Hands-on adjustments

During in-person yoga classes, workshops, events and retreats, an instructor may offer hands-on adjustments or physical guidance where appropriate.

Hands-on adjustments are voluntary. Participants may decline an adjustment at any time and do not need to provide a reason.

Participants may also change their preference at any time, including after previously accepting hands-on adjustments.

Where Behind the Yoga Mat uses verbal consent, consent cards, visual indicators or another method for communicating preferences regarding physical adjustments, participants are expected to communicate their preference accordingly.

Personal responsibility

Participants remain responsible for practising within their own limits and for communicating where an exercise, adjustment or activity does not feel appropriate for them.

Participation is voluntary, and participants may pause, modify or choose not to perform an exercise.

Nothing in this section excludes or limits liability where such exclusion or limitation is prohibited by applicable law.

10. Intellectual Property and Personal Use

Unless expressly stated otherwise, all content created or made available by Behind the Yoga Mat, including but not limited to:

  • online courses and course structures;
  • videos and audio content;
  • presentations;
  • workbooks and worksheets;
  • templates, checklists and exercises;
  • written educational materials;
  • graphics and downloadable resources;
  • original teaching and training materials;
  • live-session materials; and
  • website and member-area content,

is owned by or licensed to Behind the Yoga Mat and is protected by applicable copyright and intellectual property laws.

Your right to use the materials

Purchase of a course, programme, coaching package or other product grants you a limited, personal, non-exclusive and non-transferable right to access and use the relevant materials for your own personal or internal professional learning purposes.

Purchase does not transfer ownership, copyright or other intellectual property rights to you.

These provisions apply to both consumers and business customers.

You are permitted to apply the knowledge, skills and principles you learn through our courses and programmes in your own personal or professional activities.

However, this does not give you the right to copy, reproduce, redistribute or commercially exploit Behind the Yoga Mat's protected content or materials.

Prohibited use

Unless Behind the Yoga Mat has given prior written permission, you may not:

  • copy, reproduce or substantially reproduce course materials;
  • forward or share course materials, workbooks, templates, videos, audio content, recordings or downloads with third parties;
  • provide another person with access to a paid course, programme or member area;
  • share, publish, sell or transfer your login credentials;
  • upload protected materials to websites, social media, cloud-sharing services, online groups or other platforms;
  • sell, license, sublicense or otherwise commercially distribute our materials;
  • remove copyright, ownership or other proprietary notices;
  • reproduce or distribute our materials as part of another course, training, workshop, programme or commercial product; or
  • make Behind the Yoga Mat materials available within a company, organisation, team, client group or training programme unless such use has been expressly authorised.

Protection of our intellectual property

Unauthorised copying, sharing, publication, distribution or commercial use of Behind the Yoga Mat materials may constitute a breach of these Terms and an infringement of applicable intellectual property rights.

Where such use is identified, Behind the Yoga Mat may take reasonable and proportionate measures to protect its rights.

Depending on the circumstances and subject to applicable law, this may include:

  • requesting that the unauthorised use cease;
  • requesting removal of copied or distributed materials;
  • restricting or terminating access to the affected course, programme or platform;
  • asserting claims arising from the infringement; and
  • pursuing other remedies available under applicable copyright or intellectual property law.

Any statutory rights and remedies available to Behind the Yoga Mat remain unaffected.

11. Recordings, Community and Confidentiality

Behind the Yoga Mat may provide live online sessions, group programmes, coaching calls, workshops, community areas and other services in which participants interact with Behind the Yoga Mat or with each other.

These environments may contain copyrighted content as well as personal, professional or other non-public information relating to participants.

Recording, screenshots and reproduction

Participants may not record, screen-record, photograph, reproduce, livestream, publish or distribute live sessions or their content without prior permission from Behind the Yoga Mat and, where relevant, the affected participants.

This applies to audio recordings, video recordings, screenshots and other forms of reproduction.

Behind the Yoga Mat may record certain live sessions where recordings form part of a programme or are intended to be made available to participants.

Where a session is recorded by Behind the Yoga Mat, participants will be informed appropriately and personal data will be handled in accordance with our Privacy Policy and applicable data-protection requirements.

The fact that Behind the Yoga Mat records a particular session does not give participants permission to make their own recording or distribute a recording made available to them.

Community and group confidentiality

Certain programmes may include community functions, discussion areas, group coaching, live calls, internal messaging or other forms of participant interaction.

Participants are expected to respect the privacy and confidentiality of other participants.

Personal experiences, business information, personal circumstances or other non-public information shared by another participant within a closed programme or community must not be recorded, copied, published or disclosed outside that environment without the person's permission.

Appropriate community use

Participants must not use community, messaging or group functions to:

  • harass, threaten or intimidate another person;
  • publish unlawful, discriminatory or abusive content;
  • deliberately disrupt the learning or community environment;
  • send unsolicited advertising, promotions or spam;
  • collect or use another participant's personal information for unrelated purposes;
  • infringe another person's privacy, confidentiality or intellectual property rights; or
  • distribute Behind the Yoga Mat materials contrary to Section 10 of these Terms.

Behind the Yoga Mat may take reasonable and proportionate action in response to serious or repeated misuse, including removal of content, restriction of community functionality or temporary suspension of access.

Serious or repeated breaches may result in termination of access in accordance with these Terms and applicable law.

Live online classes, group programmes, coaching sessions, mentoring sessions and similar services may include scheduled live participation in addition to digital materials.

The dates, duration, number of sessions and included services will be described in the relevant offer.

Where a consumer expressly requests that a service begin during an applicable statutory withdrawal period, specific statutory rules concerning early performance and withdrawal may apply.

Where required by law, we will obtain the necessary request or consent separately from acceptance of these Terms.

The fact that a programme contains both live services and digital materials may affect the applicable statutory withdrawal rules. The classification and mandatory rights applicable to the specific offer therefore remain unaffected by these general Terms. EU consumer rules distinguish between services, digital services and digital content for withdrawal purposes.

Specific voluntary cancellation arrangements for coaching and live programmes, where offered, are addressed in the cancellation section later in these Terms.

12. Cancellation, postponement or changes by Behind the Yoga Mat

Behind the Yoga Mat may need to cancel, postpone, reschedule or reasonably modify a class, workshop, event, retreat, live programme or coaching service where this is necessary due to circumstances beyond its reasonable control or where delivery would otherwise be impossible, unsafe or unreasonable.

Such circumstances may include instructor illness or incapacity, insufficient participant numbers, venue cancellation or unavailability, severe weather or other safety concerns, natural disasters, fire or flooding, epidemics or public-health restrictions, governmental measures, strikes affecting essential services, transportation disruption, significant technical problems affecting an online service, or failure of essential infrastructure.

Cancellation

Where Behind the Yoga Mat cancels a service entirely and no suitable alternative or replacement date is provided and accepted, amounts paid directly to Behind the Yoga Mat for the cancelled service will generally be refunded, subject to applicable law.

Postponement, rescheduling or material changes

Where a service is postponed, rescheduled or materially changed, participants will be informed of the new arrangements and any available options, as appropriate to the circumstances and applicable law.

Minimum participant numbers

Where an event, retreat, workshop or programme requires a minimum number of participants, Behind the Yoga Mat may cancel the service if this minimum is not reached. Where practical, any applicable minimum participant requirement will be stated in the relevant offer or booking information.

If Behind the Yoga Mat cancels a service for this reason, amounts paid directly to Behind the Yoga Mat for that service will be refunded.

Independently booked expenses

Behind the Yoga Mat is not responsible for independently booked flights, transportation, accommodation or other third-party expenses solely because a service is cancelled, postponed, rescheduled or changed, except where liability cannot legally be excluded.

Where accommodation or another service was contracted directly with a hotel, venue or other third-party provider, any refund relating to that separate contract is governed by the terms agreed with that provider.

Participants arranging travel in connection with retreats or events are strongly encouraged to obtain appropriate travel and cancellation insurance.

Circumstances beyond reasonable control

Neither party is responsible for a failure or delay in performing contractual obligations to the extent that performance is prevented by circumstances beyond that party’s reasonable control, subject to mandatory law.

This does not remove statutory rights concerning refunds, termination or other remedies where those rights apply despite the relevant circumstances.


13. Liability and Statutory Rights

Behind the Yoga Mat aims to provide its services professionally and with reasonable care and is responsible for its contractual obligations in accordance with applicable law.

Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by mandatory law.

In particular, nothing in these Terms is intended to unlawfully exclude or restrict liability for intentional misconduct, gross negligence, personal injury or other liability that cannot legally be excluded or limited.

Participants remain responsible for circumstances within their own sphere of responsibility, including:

  • failure to follow reasonable safety instructions;
  • participation contrary to known personal limitations;
  • misuse of account or login credentials;
  • unauthorised use or distribution of course materials; or
  • technical problems caused by their own equipment, software or internet connection.

Behind the Yoga Mat does not guarantee a particular physical, personal, professional, business or financial result from participation in a course, programme, coaching service, workshop, event or retreat.

Any limitation of liability applying specifically to business customers applies only to the extent permitted by law and does not reduce mandatory rights available to consumers.

Statutory warranty rights

Nothing in these Terms excludes or limits statutory warranty rights.

Where applicable, Behind the Yoga Mat is responsible for ensuring that products, digital content and digital services conform to the relevant contract in accordance with mandatory consumer law.

If purchased digital content has a material technical defect, cannot be accessed as contractually agreed, or a service has not been provided as agreed, participants should contact Behind the Yoga Mat so that the issue can be assessed and, where appropriate, remedied.

Voluntary cancellation and refund policies do not replace or restrict statutory warranty rights.

Mandatory consumer rights

Any rights granted to consumers under applicable mandatory consumer-protection law remain unaffected by these Terms.

Where a provision of these Terms conflicts with a mandatory legal right that cannot validly be excluded or restricted, the mandatory legal provision takes precedence.

14. Third-Party Services

Behind the Yoga Mat may use third-party providers to support or deliver certain services, including online learning platforms, payment providers, video-conferencing services, communication tools, venues, accommodation providers and other technical or organisational service providers.

Where a third-party service is used by Behind the Yoga Mat as part of a service purchased directly from us, Behind the Yoga Mat remains responsible for its own contractual obligations in accordance with applicable law.

Where you enter into a separate contract directly with a third party — for example, by booking accommodation directly with a hotel or retreat venue — that provider's own terms, payment conditions and contractual policies apply to that separate relationship.

The processing of personal data by Behind the Yoga Mat and relevant service providers is addressed separately in our Privacy Policy.

15. Suspension or Termination for Misuse

Behind the Yoga Mat may take reasonable and proportionate measures where a participant materially breaches these Terms.

This may include, in particular:

  • unauthorised account sharing;
  • copying, sharing, publishing or distributing protected course materials;
  • unauthorised recording or distribution of live sessions;
  • serious or repeated misuse of community or communication functions;
  • harassment of other participants;
  • fraudulent or unlawful activity;
  • deliberate interference with our platforms or services; or
  • serious infringement of intellectual property, privacy, confidentiality or other legal rights.

Where appropriate, the participant may first be notified and given a reasonable opportunity to stop or remedy the breach.

Where immediate action is reasonably necessary to protect other participants, our systems, confidential information or intellectual property, access may be temporarily restricted or suspended without prior notice.

A sufficiently serious or repeated breach may result in termination of access to the affected service, subject to applicable law.

Termination resulting from a participant's material breach does not automatically create a right to reimbursement for services already provided or for losses resulting from the participant's own breach.

Any further rights or remedies available to Behind the Yoga Mat under applicable law remain unaffected.


16. Changes to These Terms

The version of these Terms applicable to a purchase is generally the version made available when the relevant contract is concluded.

Behind the Yoga Mat may update these Terms for future purchases where necessary, including to reflect changes in:

  • services or products;
  • applicable law;
  • technical systems;
  • business activities; or
  • reasonable organisational requirements.

Publication of a newer version of these Terms does not by itself retrospectively alter an existing contract.

Where a change to an ongoing contractual relationship requires the customer's consent under applicable law, the change will not take effect solely through publication of updated Terms.

17. Severability

If an individual provision of these Terms is invalid, unlawful or unenforceable, this does not automatically affect the validity of the remaining provisions.

The legal consequences of an invalid or unenforceable provision will be determined in accordance with applicable law.

Nothing in this section is intended to replace an invalid provision with a provision that would disadvantage a consumer contrary to mandatory consumer-protection law.

18. Governing Law and Jurisdiction

These Terms and contracts with Behind the Yoga Mat are governed by Austrian law, subject to mandatory consumer-protection rules.

For consumers, this choice of law does not deprive them of mandatory protections applicable under the law of their country of habitual residence where such protections cannot legally be excluded by agreement.

For business customers, the competent court at the place of business of Behind the Yoga Mat shall have jurisdiction to the extent legally permitted.

For consumers, the applicable statutory jurisdiction rules apply.

Nothing in these Terms requires a consumer to bring proceedings exclusively in Austria where mandatory law provides otherwise.

19. Alternative Dispute Resolution

Where legally required, Behind the Yoga Mat will provide consumers with information concerning the competent alternative dispute-resolution body.

Behind the Yoga Mat is not obliged to participate in proceedings before a consumer arbitration body unless participation is required by applicable law or Behind the Yoga Mat expressly agrees to participate.

These Terms govern the contractual relationship between Behind the Yoga Mat and its customers and participants.
